Should Jordon be entitled to collect damages from Cook’s Department Store? Why or why not?
Cook’s Department Store advertises that it maintains in its store a barbershop managed by Hunter. Actually, Hunter is not an employee of the store but merely rents space in it. While shaving Jordon in the barbershop, Hunter negligently puts a deep gash into one of Jordon’s ears, requiring ten stitches. Should Jordon be entitled to collect damages from Cook’s Department Store? Why or why not?
Organization CDS had advertised that Individual H was one of their cooks who also worked as their barber. People that watched the advertisement assumed that Individual H, who works for Organization CDS, has apparent authority. Individual J approached Individual H in good faith after watching the advertisement. Because of this reason, Organization CDS is responsible to pay for the damages caused to Individual J. If the organization did not make such an advertisement, which stated the relationship between them and Individual H, only Individual H would have been responsible for the damages caused to Individual J.
Individual J is entitled to collect damages from Organization CDS as the organization had advertised that Individual H worked for them, thereby giving apparent authority to Individual H. If the advertisement was not made by organization CDS, they would not have been liable for the injuries caused to Individual J.
